1 – Object of the online contract and its definition

“Online” contract means a distance contract, ie a legal transaction concerning movable items and / or services entered in between a supplier, Falca s.r.l. with headquarters in Via Degli Imprenditori 71, Valeggio sul Mincio (Verona) and a customer consumer in the context of a distance selling system organized by the supplier, who, for this contract, uses the remote communication technology called the “internet”.
All contracts, therefore, will be concluded directly through the access by the consumer customer to the corresponding website at the address: OUIGAL.COM, where, following the procedures indicated, he will conclude the contract for the purchase of the item. A final consumer is the physical person who purchases goods and services for purposes which are not directly related to his professional activity. Hereafter we indicate the sales conditions that will remain effective unless they are changed by the supplier. Any changes related to the terms of sale will be effective from the time they are published on the website and refer to sales made from that moment on.

2 – Sales prices and methods of purchase

All sale prices of the services shown and indicated on the website, for which they constitute an offer to the public pursuant to art. 1336 of the Civil Code, are inclusive of V.A.T. and any other taxes (unless otherwise indicated). Where a transport is presumed, the cost is duly highlighted in the appropriate page on the site that the customer will take care to see before confirming his purchase; in the event of delivery abroad, any additional costs due to taxes or duties provided for by the regulations in force in the destination Country will be at the expenses of the consumer. The purchase contract is perfected through the exact compilation and consent to the purchase given through the adhesion “on line”. The customer can pay for the goods ordered using only the payment methods indicated on-line at the time of purchase. Estimated delivery time is 2 days.

3 – Obligations of the purchaser

The consumer agrees and is obliged, once the “on line” purchase procedure has been concluded, to provide for the printing and preservation of the present general conditions, which, moreover, he will have already viewed and accepted as an obligatory step in the purchase, as well as of the specifications of the product object of the purchase, and this in order to fully satisfy the condition referred to in art. 3 and 4 of the Legislative Decree. No. 185/1999. It is strictly forbidden for the purchaser to enter false, and / or invented, and / or fancy data, in the registration procedure necessary to activate the process for the execution of the present contract and the related additional communications; personal data and the e-mail address must be exclusively his/her real personal data and not of third parties, or fancy ones. It is expressly forbidden to make double registrations corresponding to a single person or enter data of third parties. The company reserves the right to prosecute any violation or abuse, in the interest and for the protection of all consumers.

4 – Right of withdrawal and complaints

The consumer who for any reason is not satisfied with the purchase made, has the right to withdraw from the purchase, without any penalty and without specifying the reason, within 14 working days from the conclusion of the contract. The withdrawal must be notified by sending in the aforementioned term of 14 days a registered letter with return receipt to the following address: Falca s.r.l, Via Degli Imprenditori 71, Valeggio sul Mincio (VR) Italy. Within the same period, a fax can be sent to 045/795 0253 or an email to shop@ouigal.com to be followed by the aforementioned registered letter with acknowledgment of receipt of the withdrawal notice within 48 hours. Within the aforementioned term of 14 days, all goods purchased intact and in their original packaging, not yet worn or used, without any lack, must be returned to the sender-supplier. Return fees will be charged to the customer.
As foreseen by the directive assessed in regulation 524/2013 / EU by the European Commission to protect the parties involved in the purchase process on an e-commerce, any complaints can be reported on the ODR.

5 – Contract resolution and express termination clause

Falca s.r.l has the right to terminate the stipulated sales contract by simply informing the customer with adequate and justified reasons; in this case the customer will be entitled exclusively to the refund of any sum already taken and paid.

6 – Jurisdiction and competent court

Any dispute concerning the application, execution, interpretation and violation of purchase contracts stipulated “on line” through the ouigal.com website is subject to Italian jurisdiction; these general conditions are reported, although not expressly provided for therein, to the combined provisions of Legislative Decree No. 50 dated 15.1.1992 and Legislative Decree No. 185 of 22.5.1999. For any controversy between the parties concerning the present contract the Court of residence of the Customer or elective domicile of the final consumer will be the competent (Art. 1469 Bis N ° 19) one. For all the others will be competent the court of Verona.

Returns

You can return any product purchased on OUIGAL.COM within 14 working days from the delivery date.
That is how:

  1. Make sure the products are in the same conditions as you received them, including unworn or used packaging.
  2. Contact us by e-mail to shop@ouigal.com or fax to 045/795 0253 specifying the number which you will find on the box, of your order, specifying model / color / size that you have purchased.

We also remind you that:

  • In case the return is due to our mistake or a defect of the goods the shipping costs will be at our expense and you can request a change of goods, or the cancellation of the full amount (including shipping costs).
  • In case the return is due to your mistake during the ordering phase the shipping costs will be at your charge and you will be able to request the change of goods, or the cancellation of the amount of goods ordered (excluding shipping costs).

Postal charges for the return of the goods are charged to the customer, unless the return is due to our shipping error. Keep always the shipping note and the postal receipt of the returned package for further clarification.

How to order
After selecting the size of the items you want to buy, use the “ADD TO CART” button.
Once you have added the desired items to your cart, complete the order by selecting the payment method you prefer:

In case of advance payment if we do not receive the payment within two days the order will be canceled.
After each order, you will receive from one of our managers an e-mail confirming the shipping. Remember to check your e-mail in the hours following the order to know the status of your order and its shipping code.
We ship by DHL courier, delivery in 3/4 working days.

During holidays, due to the closure of our offices, shipping may be delayed with respect to the times indicated. Example: If you want to make a Christmas gift, to get the package by December 25th we suggest you to place your order at least 10 days in advance.
Shipping is entrusted to the express courier DHL. If you are not at home at the time of delivery, DHL will leave you a notice and will try the delivery again the next day. On the notice you should find all the references for the delivery. If you are not at home even at the second delivery your order will remain in storage at the nearest DHL store waiting for your communication for an agreed delivery. From this moment, upon notice, it is possible to pick up the package at the DHL office in question within one week from the opening the goods in stock. If the package you receive is damaged or tampered, accept it subject to control and contact us immediately by phone. If you do not receive your order within 6 days from the shipping please contact us to check the situation and make sure that you will receive your order as soon as possible.
